St Ives in December – Event Terms and Conditions

These Terms and Conditions apply to all events organised or promoted by St Ives in December (“we”, “us”, “our”). By attending or participating in any of our events, you (“you”, “your”) agree to these Terms and Conditions.

1. General
Our events take place in public spaces in and around St Ives, Cornwall, including but not limited to The Wharf, Royal Square, local churches, venues, and beaches.
Many of our events are free to attend and open to the public. Capacity may be limited for safety reasons, and access may be restricted or refused at our discretion or that of our partners (e.g. RNLI, local authorities, venue operators).
2. Attendance at Your Own Risk
You attend and participate in our events entirely at your own risk.
You are responsible for your own safety and the safety of any dependants or guests you bring with you.
You must follow all instructions given by event stewards, security, RNLI crew, emergency services, and any other authorised personnel.
3. Children and Vulnerable People
All children under 18 must be accompanied and supervised at all times by a parent, guardian, or responsible adult.
Parents/guardians remain fully responsible for the behaviour, safety, and wellbeing of the children in their care throughout the event.
We are not able to provide childcare or supervision services and cannot accept responsibility for unsupervised children or vulnerable people.
4. Health, Safety and Behaviour
You must take reasonable care for your own safety and that of others, especially in crowded areas, near the water, on uneven surfaces, and during poor weather.
You must not bring anything that could cause danger or nuisance to others (for example: fireworks, flares, weapons, illegal substances).
We reserve the right to ask anyone to leave an event if, in our opinion, their behaviour is unsafe, disruptive, or likely to cause harm or distress to others.
5. Public Spaces and Third Parties
Many of our events take place in public spaces managed by third parties (for example: harbour authorities, local council, RNLI, private venues).
We do not control all aspects of these spaces (including surfaces, lighting, tides, weather conditions, or other members of the public) and cannot accept liability for incidents arising from factors outside our reasonable control.
Where events involve third-party providers (e.g. performers, venues, activity organisers), your participation in those activities may also be subject to their own terms and conditions.
6. Liability
Nothing in these Terms and Conditions seeks to exclude or limit any liability which cannot be excluded or limited under applicable law (including liability for death or personal injury caused by our negligence).
Subject to the above, we shall not be liable for:
any loss, damage, injury, or expense suffered by you or your property while attending our events,
any indirect or consequential loss,
any loss arising from events or circumstances beyond our reasonable control (including weather, RNLI callouts, emergency incidents, or decisions by local authorities).
You are responsible for your own belongings. We accept no responsibility for lost, stolen, or damaged property.
7. Changes, Cancellations and Weather
Our events are subject to change or cancellation at short notice, including for reasons of safety, weather, RNLI operational requirements, or instructions from authorities.
We will make reasonable efforts to communicate changes via our website and social media channels, but cannot guarantee that all attendees will receive notice in advance.
We are not responsible for any costs you may incur as a result of changes or cancellations (including travel or accommodation).
8. Photography, Filming and Media
Our events may be photographed, filmed, or recorded for promotional, reporting, or archival purposes.
By attending, you acknowledge that you may appear in photographs or recordings taken in public areas and consent to the reasonable use of such material by St Ives in December for non-commercial promotional purposes.
If you have concerns about the use of an image that clearly identifies you or your child, please contact us and we will do our best to address your concerns.
9. Accessibility
We aim to make our events as accessible as reasonably possible; however, St Ives is a historic town with steep, narrow, and sometimes uneven streets.
Some areas may be difficult to access for wheelchair users, people with limited mobility, or those with pushchairs.
If you have specific accessibility needs, we encourage you to contact us in advance so we can provide information and, where possible, suggest suitable viewing areas or routes.
10. Acceptance of Terms
By attending any St Ives in December event, you confirm that you have read, understood, and agree to these Terms and Conditions and that you accept responsibility for your own safety and that of any children or dependants in your care.
11. Donations and Sponsorship
St Ives in December is a volunteer-run community group and relies on donations and sponsorship to help fund our events.
Unless expressly agreed in writing as part of a sponsorship package, all donations are given freely and without any expectation of goods, services, or other benefits in return.
Any recognition we may give to donors or sponsors (for example: a thank-you on our website or social media, or inclusion on event materials) is at our discretion and does not form part of a contractual obligation.
Donations are non-refundable, except where required by law.
